BLAST MOTION AND ZEPP LABS SETTLE PATENT LITIGATION

SAN DIEGO, California – January 2nd, 2018 – Blast Motion, Inc. (“Blast Motion”) and Zepp Labs, Inc. (“Zepp Labs”) announced the entry of a stipulated judgment and settlement in their patent lawsuit in the United States District Court in the Southern District of California.


• Pursuant to the stipulated judgment: The District Court has entered a judgment of infringement against Zepp Labs baseball, softball, golf and tennis products with respect to certain claims of United States Patent Nos. 8,903,521, 8,905,855 and 9,039,527 (“Blast Motion Patents”).

• The District Court has issued an injunction against Zepp Labs from selling or offering for sale the accused Zepp Labs baseball and softball sensor products in the United States. This injunction will go into effect in six months from the entry of the judgment.

• The District Court has also entered a judgment of infringement against Blast Motion baseball, softball and golf products with respect to certain claims of United States Patent No. 8,989,441 (“Zepp Labs Patent”).


The parties also entered into a Settlement and License Agreement that will permit the parties to continue to distribute their respective products in the United States, with the exception of the accused Zepp Labs baseball and softball sensor products.

The remaining terms of the Settlement and License Agreement between Blast Motion and Zepp Labs are confidential.

ZEPP WILL CONTINUE TO SUPPORT OUR USERS

As has been reported, on January 2nd, 2018, Zepp Labs, Inc. (“Zepp Labs”) and Blast Motion, Inc. (“Blast Motion”) announced the entry of a stipulated judgment and settlement in their patent lawsuit in the United States District Court in the Southern District of California. Zepp Labs would like to make the following points clear following this mutually agreed resolution to the dispute:


• Zepp Labs will continue to sell its sensor products, except those for baseball and softball in United States after June 17th, 2018, and will continue to support its entire suite of iOS and Android mobile applications.

• Zepp Labs will continue to support all existing Zepp baseball and softball iOS and Android users with functions currently offered within the app. (For those with pro athlete content, it will remain as available till the contract with pro athletes expire.)

• Zepp Labs will continue to introduce new baseball and softball app features for Apple Watch and other wearable devices on wrist in the future.
