"GolfSense", “ZEPP” and other related graphics, logos, service marks, and trade names used on the Site are the trademarks of Zepp Labs, Inc. and may not be used without permission in connection with any third party products or services. Other trademarks, service marks, and trade names that may appear on the Site are the property of their respective owners.

3. MODIFICATION.

Zepp Labs, Inc. reserves the right, at any time, to modify the Site Content or to modify, suspend, or discontinue the Site or any part thereof with or without notice. You agree that Zepp Labs will not be liable to you or to any third party for any modification of the Site Content or modification, suspension, or discontinuance of the Site.

Zepp Labs provides a limited one year warranty on Products purchased through the Site, as described on our Warranty page: www.zepp.com/warranty. EXCEPT AS PROVIDED ON OUR WARRANTY PAGE (WHICH IS HEREBY INCORPORATED INTO THESE TERMS), Zepp Labs DISCLAIMS ALL OTHER REPRESENTATIONS, WARRANTIES, AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SYSTEM INTEGRATION, QUIET ENJOYMENT, AND ACCURACY.

8. LIMITATION OF LIABILITY.

IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SITE OR THE SITE CONTENT, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ON ANY THEORY OF LIABILITY. To make any payments via the Site you will be required to give us (or uur third party payment services providers) a valid credit card number and associated payment information at the time you are required to make such payments, including all of the following: (i) Your name as it appears on the card, (ii) the credit card type, (iii) the date of expiration of Your credit card, and (iv) any activation numbers or codes needed to charge Your card. We collect Personal Information that You submit to Us voluntarily through the Site.

This Data Protection Declaration states what information we process about you.

GENERAL INFORMATION

When the App is downloaded, the information, which is necessary for this purpose, is transferred to the App store, in particular user name, e-mail address and customer number of your account, time of download, payment information and individual device code. However, we have no influence on this data collection and are not responsible for it. We process this data to the extent required to download the App to your mobile device. It will not be saved further.

If you use our App, the following data will be collected:

  • User identification (device identification, unique terminal number (IMEI = International Mobile Equipment Identity), unique network subscriber number (IMSI = International Mobile Subscriber Identity), mobile number (MSISDN), MAC address for Wi-Fi use, name of your smartphone, E -mail address)
  • Date and time of the request,
  • Transferred data amount,
  • Access status (file transfer, file not found),
  • Transactions called,
  • Error messages of the authentication process and application,
  • IP address (this is not shortened for security reasons).

This data is stored anonymously. The creation of personal user profiles is thus excluded. This data will be deleted or anonymised after the connection has ended.

In addition, we may collect personal data from you in the following cases:

  • when you contact us,
  • As part of the registration,
  • When you subscribe to our promotional newsletter,
  • To secure and to ensure the functionality of our services.

Personal data is processed exclusively for a specific purpose (”purpose limitation”). We also review our data-processing practices regularly to ensure that we process as little personal data as possible (“data minimization”).

WHAT IS PERSONAL DATA

Personal data means any information relating to an identified or identifiable natural person; a natural person is regarded as identifiable, if said person can be identified directly or indirectly, in particular by reference to an identifier such as a name. Personal data includes information such as: your name, address, phone number, and birth date (if applicable). Statistical information that cannot be directly or indirectly associated with you is not considered personal data.

PROTECTION OF MINORS

Processing as described in this Data Protection Declaration is based on your consent, which is free and completely voluntary for you. If you are under the age of 16 when first using the sensor and the App, your legal guardian's consent and proof thereof is required. For this purpose, the contact details of the legal guardian must be shared with us in accordance with Art. 8 para 2 GDPR as evidence of the consent or authorization of the legal guardian. This data and the minor’s personal data will then be processed in accordance with this Data Protection Declaration. Please contact support with your contact details. If we find out that a minor under the age of 16 is using the App without the consent of the respective legal guardian, we will promptly delete all data submitted to us.

PURPOSES OF DATA PROCESSING AND LEGAL BASIS

Your personal data will be processed for the following purposes, based on the following legal basis:

  • Contract execution in accordance with Art. 6 para. 1 lit. b) of GDPR.
  • Customer management in accordance with Art. 6 para. 1 lit. b) and c) of GDPR.

YOUR RIGHTS

Right to information and data portability

You have the right to information about your personal data processed by us, in accordance with Art. 15 GDPR at any time. If the data is processed based on your consent or in accordance with Art. 6 para. 1 b) of GDPR, you may also request, pursuant to Art. 20 para. 1 GDPR, to receive the personal data stored about you in a structured, commonly used and machine-readable format. Upon your request, we will also forward the data directly to the recipient of your choice.

Right to rectification, restriction and erasure

Furthermore, in accordance with Art. 16 to 18 of GDPR, you may request that we rectify, restrict (block) or erase your personal data if the data has been processed incorrectly by us, if there is a reason for restricting any further data processing, if data processing has become unlawful for any reasons or if its storage is inadmissible for other legal reasons. We point out that your right to erasure may be restricted by statutory retention periods.

Right to object

If our data processing is based exclusively on our legitimate interest in accordance with Art. 6 para. 1 lit. f) of GDPR, you can object to this processing in accordance with Art. 21 para. 1 of GDPR. If you have allowed us to process your personal data by consent, you have the right to withdraw such authorization in accordance with Art. 7 para. 3 of GDPR with future effect.

Right to file complaints with the Supervisory Authority

You are free to file a complaint with a Supervisory Authority if you believe that our processing of your personal data violates the European General Data Protection Regulation or any other national and international data protection laws, in accordance with Art. 77 of GDPR.

To ensure that personal data is not disclosed to any unauthorized third parties, we can only respond to your requests if you are clearly identified (your home address). We will then respond to your request by post.

You can also contact us by sending feedback from the Help section of the app. The data will only be processed there for as long as is necessary to resolve your concern. When this is done, the data will be deleted or anonymised.

HANDLING OF YOUR PERSONAL DATA WITHIN THE SCOPE OF THE APP

We offer you the opportunity to use certain services within the scope of the App. You must register first before using the App for the first time. To use the services of the app, we need the following information from you:

  • User general location via IP address (country, region, city).
  • User specific information via GPS (optional).
  • User Account Information (Email, Password, Facebook Authentication Information, WeChat Authentication Information, HEAD Authentication Information, AMAZFIT Authentication Information).
  • User profile information (portrait photo (optional), last name, first name, user name, gender (optional), year of birth (optional), height, body weight, right or left-handed, language setting, sports equipment model (optional), sensor ID, etc.
  • Game data (including user profile (name, portrait photo, etc.), game data (duration, score, calories, distance, speed, sprints, swings, kicks, location, heart rate, photos, videos, etc.), and swing data (speeds, angles, tempo, spin, sweet spot, etc.)).
  • Equipment data (optional).
  • Product usage behaviour (device information (manufacturer, model, operating system & version, etc.), sensor information (MAC address, battery level, etc.), application usage actions (app launch, session start, swing, etc.), application work log).
  • Swing information (speeds, angles, tempo, spin, sweet spot, etc.).
  • Camera and microphone data (all optional).

Data that you submit to us as part of the registration process, as well as later during the use of the App, is used to initiate a contract in accordance with Art. 6 para. 1 lit. a) and b) of GDPR, communication and data exchange pursuant to Art. 6 para. 1 lit. a), b), c), f) of GDPR, to ensure proper operation of a data processing system pursuant to Art. 6 para. 1 lit. c) and f) GDPR:

  • Providing the App,
  • Making your profile available within the App,
  • Use of the App,
  • Authentication of registered users.

From the first time of usage, the sensor stores technical data (such as acceleration or movement) without making any reference to your person. Only after a successful registration within the scope of the App, will your sensor data be personally assigned to you and submitted for analysis. Please note that your data can only be processed properly if the sensor is used exclusively by you. From the time of registration, we process not only the personalized sensor data but also the data you have stored in the App. If you have uploaded your profile photo and have entered your name in the App, all App users can use the search function to view your name and profile photo. If you register through an existing account (such as ZEPP, Amazfit, Facebook, Google or WeChat), you agree that we will access the information about you held in this account (such as your name, email address, photo, and gender) and that it will be processed for the purposes described in this Data Protection Declaration. For this purpose, you must explicitly consent to the data transfer from the respective existing account while registering through said account.

REGISTRATION

For an effective registration, we will need a valid e-mail address. For this purpose, we log the registration and the submission of a welcome mail. No further data will be collected. PROFILING

The personal data assigned to you will serve for analysing your playing technique, based on an advanced evaluation (profiling) in order to provide concrete optimization recommendations for you. In addition, we may use 3rd party tools (such as Mixpanel) to track the usage behaviour of the App.

COOKIES

We use the so-called "cookies" in some areas of our App, for example, to recognize the preferences of our visitors and to optimise the design of the App. This allows a simpler navigation and a high degree of user-friendliness. Cookies also help us identify particularly popular areas of our App offering. Cookies are small files that are stored in on a user’s device. They allow information to be kept for a certain period of time and to identify the device. We use permanent cookies for better user guidance and individual performance. We also use the so-called "session cookies", which are automatically deleted when you close the App. You can set your mobile device/App to notify you of any cookies placed. Therefore, the use of cookies becomes transparent for you. If you completely exclude the use of cookies, you may not be able to use individual features of our App. The following cookies are used:

  • Cookie 1: Zepp: This indicates which user is sending the current request.
  • Cookie 2: AWSELB: This indicates which server is assigned to the user.

DATA PROCESSING FOR ADVERTISING PURPOSES

If you have given us the following consent for advertising purposes, we may use your data for sending you promotional material and information about marketing measures (such as sales) from Zepp.

“I hereby agree to receive marketing emails from Zepp generally on an irregular basis, in particular to be informed about any changes related to the app. You can withdraw your consent with future effect, or withdraw your authorization for further processing of your personal data for sending the newsletter at any time, by pressing the "unsubscribe" link available in the newsletter.”

DATA RECIPIENT

We limit access to your personal data stored by us to our employees and the service providers commissioned by us, who have to handle these personal data due to their task. A data exchange within the group of companies to which we belong (the Zepp group of companies), exclusively for internal administrative purposes. We use external service providers to render services and to process your data (including data hosting in a secure data centre and for maintenance and analysis of databases). These external service providers act as processors as described in Art. 28 of GDPR. The service providers process data exclusively as per our instructions, and have been obliged to comply with the applicable data protection regulations. All processors have been carefully selected, and will only have access to your data as required for rendering the services to the extent and for the period required, or to the extent to which you have consented to the processing and use of the data.

TRANSMISSION TO THIRD COUNTRIES AND LEGAL BASIS

Personal data will be transferred to third countries in the USA and China, to support the functionality of the App, pursuant to Art. 46 para. 2 lit c) of GDPR. For this purpose, you have submitted the following consent form as part of our App:

"I agree that all data I store in this App may also be stored by/with our service provider in the USA."

The servers and offices of some of our service providers are located in the USA and other countries outside the European Union. Companies in these countries are subject to data protection laws that in general do not protect personal data to the same extent as in the member states of the European Union. If your personal data is processed in a country that does not have a recognized level of data protection such as the European Union, we will use contractual or other recognized means to ensure that your personal data is properly protected. Likewise, these service providers must oblige their own service providers accordingly.

DATA ERASURE

Your personal data will be erased as soon as it is no longer necessary to fulfil the stated purposes. Also, we will erase your data if its storage is inadmissible (especially if the data is incorrect and it is not possible to correct it). Other than that, data may be erased at any time upon your express request, or if you erase the data in your App. As soon as you are back in the WLAN, data will be erased from our servers. The aforementioned erasure will be replaced by blocking if any legal or actual obstacles stand in the way (e.g. special storage requirements).

DATA SECURITY

We maintain diverse security measures in the sense of Art. 32 of GDPR (technical and organizational measures) for protecting your personal data. In order to protect your personal data within the App, data is always encrypted. If you contact us by web form, please note that the confidentiality of the information transmitted is not guaranteed. Therefore, we recommend that you send us any confidential information by post.
